Welcome to Blue, operated by Maslow Labs, LLC (“us,” “we,” the “Company” or “Blue”).

1. ACCEPTANCE OF TERMS OF USE AGREEMENT  
By creating a Blue user account, whether through a mobile device or application (collectively, the “Service”) you agree to be bound by (a) these Terms of Use and (b) our Privacy Policy and, each of which is incorporated by reference into this Agreement, and (c) any terms disclosed and agreed to by you if you purchase additional features, products or services we offer on the Service (collectively, this “Agreement”). If you do not accept and agree to be bound by all of the terms of this Agreement, then please do not use the Service.

We reserve the rights and will regularly make changes to this Agreement and to the Services, We will do this for a range of reasons, including requirements or changes to the laws, changes in our business model, and new features. When we post changes to this Privacy Policy, we will revise the “last updated” date at the top of this Privacy Policy, which will be posted on the Services under “Settings” and also on tryblueapp.com, and you should regularly check for the most recent version, which is the version that applies. These changes are effective immediately, after they are posted on this page. If we make any material changes to this Privacy Policy, we will notify you of the changes by reasonable means, which could include notifications through the Services or via other digital communications.

2. ELIGIBILITY
You must be at least 18 years of age to create an account on Blue and use the Service. By creating an account and using the Service, you represent and warrant that:

-you can form a legal binding contract with Blue,

-you will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations,
-you are not a person who is barred from using the Service under the laws of the United States or any other applicable jurisdiction–meaning that you do not appear on the U.S. Treasury Department’s list of Specially Designated Nationals or face any other similar prohibition, and
-you have never been convicted of a felony and that you are not a registered sex offender with any state, federal or local sex offender registry.


  1. YOUR ACCOUNT
    In order to use Blue, you must sign in using your Facebook login. You may also authenticate other third party Social Media Services including, but not limited to Instagram, Spotify, and Twitter. If you do this, you authorize us to access and use certain account information, including but not limited to your public profile and information about friends you share in common with other Blue users to help make better matches. You may refer to our Privacy Policy for more information regarding the information we collect from you and how we use it.


You are responsible for maintaining the confidentiality of your login information you use to sign up for Blue. You are solely responsible for all activities that occur under those credentials. If you think someone has compromised and gained access to your account, please immediately contact [email protected].

4. MODIFYING THE SERVICES AND TERMINATION
At Blue, our goal is to improve your experience on the Service, including but not limited to releasing new additional features and updating our Community Standards. From time to time, you may notice the removal of some features and the introduction of new features. As long as these changes do not affect your rights or obligations on the Service, we may not provide you advance notice before taking them.

 

At any given time or any reason, you may terminate by following the instructions in “Settings” in the Service. At the same time, Blue may terminate your account without notice if we believe that you may have violated this Agreement. After we terminate your account, this Agreement will terminate.


  1. SAFETY: YOUR ENGAGEMENT WITH OTHER USERS
    At Blue, we strive to encourage a positive and respectful user experience. However, we are not responsible for the conduct of any user on or off the Service. By using the Service, you agree to engage and interact with other users with caution. Under no circumstance should you provide financial information (for example, your credit card or bank account information) or your login credential, or send money, to other users.

 

BY USING THE SERVICE, YOU ARE SOLELY RESPONSIBLE FOR ALL ENGAGEMENTS AND INTERACTIONS WITH OTHER USERS. YOU UNDERSTAND THAT BLUE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON OUR USERS OR OTHERWISE REQUIRE THEM AS PART OF OUR REGISTRATION PROCESS. BLUE MAKES NO REPRESENTATIONS, WARRANTIES, OR PROMISES AS TO THE CONDUCT OF USERS. BLUE RESERVES THE RIGHT TO CONDUCT ANY CRIMINAL BACKGROUND CHECK OR APPROPRIATE SCREENINGS AT ANY TIME USING AVAILABLE PUBLIC RECORDS.


  1. RIGHTS BLUE GRANTS YOU
    Blue grants you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sublicensable license to access and use the Service. This license is for the sole purpose of letting you register, use, and enjoy the benefits on the Service as designed and intended by Blue and permitted by this Agreement. By using the Service, you agree not to:

-maliciously compromise the security of the Service

-remove or tamper identifiers of Blue to disguise the origin of any information transmitted to or through the Service

-modify, change, adapt, sublicense, reverse engineer, translate, sell, desciper, or otherwise any part of the Service, or cause others to do so

-create, develop, or use third-party applications that interact with the Service or other users’ Content or information

-use, access, or publish Blue application programming interface

-encourage other users or promote activity that violates this Agreement or compromises the integrity of the Service, the app, community, or platform

-use or reproduce Blue’s copyrighted worldwide trademarks, service marks, name, material, images, design, trade names, or other intellectual property

-use any bot, robot, spider, crawler, scraper, proxy, or other manual or automatic device, method or process to access, retrieve, index, “data mine,” or in any way to reproduce or circumvent the navigational structure or presentation of the Service or its contents

-misrepresent yourself to imply that any statements you make are endorsed by Blue

 

The Company will investigate and take legal action in response to illegal and/ or unauthorized uses of the Service, including termination of your account.

Any software that we provide you may automatically download and install upgrades, updates, or other new features. You may be able to adjust these automatic downloads through your device’s settings.

7. RIGHTS YOU GRANT BLUE
Through the creation of an account, you grant to Blue a worldwide, transferable, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information you authorize us to access from third parties such as, but not limited, to Facebook, Instagram, or Twitter, as well as any information you post, upload, display or otherwise make available (collectively, “post”) on the Service or transmit to other users (collectively, “Content”). Our license to your Content is subject to your rights under applicable law (for example laws regarding personal data protection to the extent any Content contains personal information as defined by those laws) and is for the limited purpose of operating, developing, providing, and improving the Service and researching and developing new ones. You agree that any Content you place or that you authorize us to place on the Service may be viewed by other users and may be viewed by any person visiting or participating in the Service (such as individuals who may receive shared Content from other Blue users).

You agree that all information that you submit upon creation of your account, including information submitted from your Facebook account, is accurate and truthful and you have the right to post the Content on the Service and grant the license to Blue above.

You understand and agree that we may monitor or review any Content you post as part of a Service. We may delete any Content, in whole or in part, that in our sole judgment violates this Agreement or may harm the reputation of the Service.

You agree to be respectful and kind when communicating with our customer care representatives. If we feel that your behavior towards any of our customer care representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your account.

In consideration for Blue allowing you to use the Services, you agree that we, our affiliates, and our third-party partners may place advertising on the Services. By submitting suggestions or feedback to Blue regarding our Services, you agree that Blue may use and share such feedback for any purpose without compensating you.

You agree that Blue may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary, such as to: (i) comply with legal process; (ii) enforce this Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your requests for customer service; or (v) protect the rights, property or personal safety of the Company or any other person.

Blue may terminate your account for any reason.

 

  1. COMMUNITY GUIDELINES

 

Welcome to the Blue community, where we do our best to create a respectful, trustworthy and pleasant environment. Our goal is to allow users to be themselves, without any pretenses or filters, as long as it doesn’t offend others. When using Blue, please follow these guidelines both on and offline.

 

  1. Phone Numbers and Private Information.
    1. On Blue we help protect your private & confidential information by keeping it off your profile. The only time your information is shared is when you choose to, after you are mutually connected through Blue’s private message line. Posting of any private information such as phone numbers, social security numbers, and financial information is subject to removal.  

 

  1. PG Content:
    1. We do not tolerate violent, graphic or obscene photos or profiles. Any content that contains nudity, pornography, or illegal activity will be removed. Any content that we deem disrespectful to others may be removed, and the user banned, depending on its severity.

 

  1. Copyright Infringement:
    1. Any content that you upload, you must have the legal rights to. If someone else owns the copyright to (and has not granted you authorization to use) anything on your profile, it may be deleted.

 

  1. Hateful Conduct and Harassment:
    1. We have a zero-tolerance policy on hate speech or harassment. Any content written intentionally to promote or condone violence against individuals or groups based on race or ethnicity, religion, disability, gender, age, nationality, sexual orientation or gender identity is strictly forbidden and will be removed. Blue reserves the right to ban any user that has exhibited behavior that is threatening, intentionally malicious, or harmful to other users.

 

  1. Scamming
    1. Anyone attempting to steal or coerce other users into sharing private information for fraudulent or illegal activity will be banned. Any user caught sharing their own financial account information for the purpose of receiving money from other users will also banned from Blue.
  1. Advertising or Commercial Solicitation
    1. Do not post any links to commercial spam or promote any service or product on Blue. If your messages are intended to solicit other users on Blue, it will be removed.



Blue reserves all the right to conduct an investigation and/or terminate your account if you have misused the Service or behaved in a way that we deem as illegal or inappropriate. These behaviors may include, but not limited to the way you communicate or act off the Service but involve users you meet through the Service.


  1. OTHER USERS’ CONTENT
    Although Blue reserves the right to investigate, review, and remove Content that violates this Agreement, the Content shared on the Service is the sole responsibility of the user who posts it. We cannot guarantee that all Content on the Service will comply with this Agreement. When you encounter or see Content on the Service that violate this Agreement, please report it to us within the Service or email us via [email protected]
